Heard Sri Yashwant Pratap Singh along with Sri Brijesh Kumar Pandey, learned counsel for the applicant, Sri Bhupendra Pal Singh, learned A.G.A. for the State and perused the record. 2. Instant bail application has been filed with a prayer to release the applicant on bail during the trial in Case Crime No. 98 of 2026, under Sections 87, 64, 62, 352, 351(2), 3(5) BNS, Police Station- Cantt., District Gorakhpur. 3. Contention of learned counsel for the applicant is that though in the FIR, allegations have been that the applicant has tried to commit rape upon the victim along with two other co-accused persons and the applicant was also arrested on spot by the police. However, there is no eye witness of the incident in question and even the victim did not support the prosecution story in her statement recorded under Section 180 BNSS, therefore, the applicant has bee
