The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Complaint Case No. 30 of 2008, under Sections 395, 354, 427, 323, 325 IPC, Police Station- Allapur, District Badaun, during pendency of trial. Learned counsel for the applicant has contended that a false case was lodged against the applicant and other co-accused and after investigation final report was submitted in favour of them. Thereafter, the complainant filed a protest application, which was treated as a complaint case and upon statement of the first informant and other witnesses, recorded under Sections 200 and 202 Cr.P.C., the learned Magistrate summoned the applicant and other co-accused under Sections 395, 354, 427, 323, 325 IP
