The present application is filed under Section 397 of the Code of Criminal Procedure, 1973 (hereinafter referred to as the “Code”) read with Section 401 of the Code at the instance of the original accused – petitioner herein challenging the order dated 5th October 2018 passed by the learned 5 th Additional Session Judge, Mehsana at Visnagar in Criminal Appeal No. 26 of 2016 and the order dated 10 th October 2016 passed by the learned Additional Chief Judicial Magistrate, Visnagar in Criminal Case No. 1707 of 2015.
