The appellant - State of Gujarat has preferred this appeal under Section 378(1)(3) of the Code of Criminal Procedure, 1973 against the judgment and order dated 30.06.2012 passed by the learned Additional Sessions Judge, Gondal (hereinafter be referred to as “the trial Court”) in Sessions Case No.67 of 2010, whereby the trial Court has acquitted the original accused (respondent herein) from the offences punishable under Sections 363, 366 etc of the Indian Penal Code (hereinafter be referred to as “the IPC”). Short facts of the prosecution case are that the complainant was residing at Darshan Park Society at Shapar Veraval Village wherefrom the accused allured his sister on 03.04.2010 under the pretext of any reason and as such, he kidnapped his sister knowing fully well that the sister of the complainant was minor induced her for any reason.
