The appellant - State of Gujarat has preferred this appeal under Section 378(4) of the Code of Criminal Procedure, 1973 against the judgment and order dated 30.05.2011 passed by the learned Chief Judicial Magistrate, Junagadh (hereinafter be referred to as “the trial Court”) in Criminal Case No. 2161 of 1984, whereby the trial Court has acquitted the original accused (respondents herein) for the offences punishable under Section 18(A)(C) of the Drugs Act. Facts of the present case are that the Drug Inspector – Somalal Amulakh Purohit visited the medical store of the accused running in the name and style of M/s.Ethico Sales Agency and upon inquiry, it was found that though the medicines were outdated, the accused were selling those medicines after changing their label and thereby the accused have committed alleged offences. Hence, the complaint being C.R.No.II – 189/1993 came to be regist
