The appellant-State has preferred this appeal under Section 378 (1)(3) of the Code of Criminal Procedure, 1973 against the judgment and order dated 30.3.2010 passed by the learned Additional Sessions Judge and Fast Track Court No.2, Patan, (hereinafter be referred to as “the trial Court”) in Session Case No. 21 of 2009 whereby the trial Court has acquitted the respondents accused from the offence punishable under Sections 324, 323, 504 r/w Section 114 of the Indian Penal Code (hereinafter be referred to as the “IPC”) and under Section 135 of the Bombay Police Act. 2. Short facts of the prosecution case are that the complainant, Rasulkhan Hamidkhan Malek, resident of village Dahegam, Taluka Radhanpur, is engaged in agriculture.
