The appellants through instant appeal are seeking modification of award dated 21.10.1993 whereby learned Additional District Judge, Panipat has not awarded compensation as claimed by them. 2. Learned Senior counsel for the appellants, at the outset, submits that appellants were owners of the acquired land. They have not been paid compensation because their land was declared surplus prior to the acquisition. They are entitled to compensation under Punjab Security of Land Tenures Act, 1953 (for short ‘1953 Act’). They did not claim compensation under aforesaid Act because they were claiming compensation under Land Acquisition Act, 1894 (for short ‘1894 Act’).
