Application under Order 39 Rule 1 and 2 CPC moved by the plaintiff- petitioner was dismissed by the trial Court on 23.07.2024 (Annexure P-3). The said order was upheld by the Appellate Court on 31.08.2024 (Annexure P-5) while dismissing the appeal of the plaintiff-petitioner. Against the aforesaid concurrent orders, the present revision petition has been filed. 2. However, it is noticed that case has already reached at the stage of rebuttal/arguments. Once it is so, the petitioner will be at liberty to raise all the contentions before the trial Court concerned. Since the main suit before the trial Court is at this stage of rebuttal, this Court does not feel it necessary to consider interference in the impugned orders passed by the Courts below. 3.
