Court No. - 65 HON'BLE SAMEER JAIN, J. 1. Heard Sri Surendra Kumar Chaubey, learned counsel for the applicant and Dr. S.B. Maurya, learned AGA-I for the State. 2. The instant bail application has been filed seeking release of the applicant on bail in Case Crime No.04 of 2025, under Sections 352, 103(1) BNS, Police Station Luxa, District Varanasi, during pendency of the trial. 3. Learned counsel for the applicant submits, however this is second bail application filed on behalf of the applicant and his first bail application has been dismissed by this Court after considering the merit of the case but he is pressing the second bail application on the ground that as per prosecution incident has been witnessed by four eye-witnesses but during trial all the eye-witnesses did not support the prosecution case and they have been declared hostile and their statements have been filed alongwith instant bail application. 4
