Elson Joseph Fernandez ...Respondent ________________ Mr. Anand Pai with Mr. Sanmish Gala or Petitioner. Mr. Vaibhav Jagdale with Mr. Pandurang Andhale for Respondent. ________________ CORAM: SANDEEP V. MARNE, J. DATED: 6 JULY 2026. Oral Judgment: 1) The issue that arises for consideration in the present Petition is whether Industrial Court at Thane can exercise jurisdiction under Section 44 of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 (MRTU & PULP Act) over order passed by the Labour Court, Thane when the Complaint of unfair labour practice relates to a cause of action arising at Bhandup. The issue arises in the light of a unique situation where the jurisdiction over Wards N, S and T of Mumbai City is conferred upon Labour Court at Thane, whereas the Industrial Court at Mumbai is conferred territorial jurisdiction over local limits of entire Mumbai City.
