Learned counsel for the petitioner submits that in the present case Baljinder Singh, co-accused was apprehended by the police, while he was carrying 54 kilograms of poppy husk in his car, without any permit or license and the petitioner was nominated as an accused in the present case on the basis of disclosure statement suffered by Baljinder Singh and later on 25 kilograms of poppy husk was recovered from the petitioner.
