The only prayer made by the counsel for the petitioner to direct the Respondent No.3 namely Sub Divisional Magistrate, Tehsil Belthara Road, District Ballia to decide representation dated 20.05.2025 submitted by the husband of the petitioner namely Shri Digvijay Singh. 2. From perusal of the aforesaid it is clear that Case No.122-B is pending consideration against the alleged encroachers. 3. In this view of the matter, the Court is of the opinion that once the matter is pending consideration before the appropriate forum, no relief could be granted to the petitioner. 4. Accordingly, the writ petition is dismissed. Insofar as the present writ petition is concerned, petitioner is free to move a proper application in the aforesaid case, if so advised.
