The order dated 07.07.2025 passed by the Sub Divisional Magistrate, Bilaspur, District Rampur/respondent no.2 in the proceedings initiated by the petitioner under Section 116 of the U.P. Revenue Code, 2006 is under challenge in the present writ petition. 2. As per 3rd schedule contained under the U.P. Revenue Code, 2006 against the aforesaid order the first appeal will lie before the Commissioner of the Division and thereafter second appeal will lie before the court of revenue. Since statutory alternative remedy is available to the petitioner to file an appeal, present writ petition is liable to be dismissed. 3. At this point of time, a prayer has been made by counsel for the petitioner to dismiss present writ petition as not pressed with liberty to file an appeal before the appellate forum. 4.
