The order dated December 09, 2025 passed by Sub Divisional Magistrate, Tehsil-Nichlaul, District Maharajganj/respondent no.2 is under challenge in the present writ petition by which auction proceedings finalized in favour of the petitioner was cancelled. 2. A preliminary objection has been raised by Sri Sudhir Bharti, learned counsel for the respondent-Gram Sabha that against the aforesaid order statutory alternative remedy is available to the petitioner to file an appeal before the Collector as provided under Rule 59 of the U.P. Revenue Code Rules, 2016. 3. At this stage, a prayer has been made by counsel for the petitioner to dismiss present writ petition on the ground of availability of statutory alternative remedy available to the petitioner. 4. In view of the same, present writ petition is dismissed on the ground of availability of statutory alternative remedy. (Prakash Padia,J.) January 19
