In view of the order proposed to be passed herein, no useful purpose would be served by putting the private respondent to notice and keeping this petition pending before this Court. However, in case the private respondent feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. It is argued by learned counsel for the petitioner that statutory appeal being Appeal No.608 of 2021 (Computerized Case No.C202102000000608) (Ram Surat Vs. Radhye Shyam) which is still pending consideration before the respondent No.1/Additional Commissioner (Judicial) Prayagraj Division Prayagraj for last more than four years. It is argued that considerable time has already been lapsed but till date no decision has been taken in the matter. 4. Heard
