Instant writ petition has arisen out of reference proceedings. 2. The Consolidation Officer has passed the order dated 28.03.2025 under Section 42A of UP Consolidation of Holdings Act, whereby chak of the present petitioner was modified. 3. It has been submitted that the order passed by the Consolidation Officer is an ex-parte order. There is nothing on the record to demonstrate that the order passed by the Consolidation Officer was ever challenged before the higher court. Reference order was passed based on the order dated 28.03.2025 passed by the Consolidation Officer. 4. After due deliberation at length, learned counsel for the petitioner has prayed to dismiss the instant writ petition as withdrawn, at this stage, on the ground of availing the appropriate remedy before the appropriate forum, as advised under the law, against the order passed by the Consolidation Officer. 5
