Heard Sri Akshay Kumar Srivastava (A/S 1501/2023) holding brief of Shri Abhishek Misra, learned counsel for the writ petitioner and Sri Ishan Shishu, learned counsel for the respondent nos. 1 and 2. 2. A preliminary objection has been raised by the learned counsel for the respondents on the premise that the present writ petition may not be maintainable, particularly, when the writ petitioner happened to be Assistant Postman and when he was denied gratuity then he preferred an original application before the respondents post dismissal of a Writ-A No. 10307 of 2024(Algoo Ram V. Union of India and 2 others) was preferred which was denied on 05.09.2024 while setting aside the order impugned therein.
