Sri Vikrant Pratap Singh, learned counsel for the writ petitioner submits that though the writ petitioner is working as Village Development Officer, however, orders have been passed on 17.11.2025 and 28.11.2025 by District Magistrate, Kushinagar and District Development Officer, Kushinagar seeking to recover surcharge from the writ petitioner. Learned counsel for the writ petitioner next submitted that the writ petitioner shall be filing an appeal before the District Magistrate, however, protection be accorded. 2. Considering the submissions so made across the Bar, the writ petition stands disposed of directing the writ petitioner to prefer an appeal before the concerned competent authority, District Magistrate, Kushinagar by 30.01.2026.
