Tripathi, learned counsel for the writ petitioner and Sri Gaurav Singh, learned Standing Counsel for the State. 2. The case of the writ petitioner is that the father of the writ petitioner namely Late Rakesh Kumar was appointed as Seasonal Collection Peon on 17.11.1998 and since the date of his appointment he continuously worked till 28.12.2016. According to the writ petitioner, he expired on 01.01.2025. The writ petitioner claims compassionate appointment. He seeks to rely upon the decision in the case of Pawan Kumar Yadav Vs. State of U.P. reported in 2011 (1) AWC, 1028 and in the case of State of U.P. Vs. Kuldeep Thakur, reported in 2017 (35) LCD page 696. 3. Learned Standing Counsel on the other hand submits that the claim of the writ petitioner is to be decided at the first instance by Respondent no.3, District Magistrate, Kannauj. 4.
