The case of the writ petitioner is that the writ petitioner is presently posted as Constable, he seeks promotion on the post of Head Constable, however, owing to pendency of a Criminal Case No. 573 of 2015 under Sections 498A, 323, 504, 506 IPC read with Section 3/4 of the DP Act has been kept in sealed cover in the year 2017. He seeks to rely upon the Government Order dated 28.05.1997 clause 10. 3. Learned Standing Counsel submits that the claim of the writ petitioner needs adjudication by second respondent, Uttar Pradesh Police Recruitment and Promotion Board, Tulsi Ganga Complex, 19-C Vidhan Sabha Marg, Lucknow, through its Secretary. 4.
