Heard Sri Ray Sahab Yadav, learned counsel for the writ petitioner and Sri S.K. Pal, learned Deputy Solicitor General of India. 2. A preliminary objection has been raised by learned counsel for the writ petitioner that the writ petitioner happens to be Assistant Divisional Medical Officer in Railways and the relief so sought for permitting the writ petitioner to resume his duties. The writ petitioner has to approach the Central Administrative Tribunal. 3. Learned counsel for the writ petitioner could not dispute the fact that in view of the judgment in L. Chandra Kumar Vs. Union of India : AIR 1997 Supreme Court 1125, the writ petitioner is to approach the Tribunal. 4. Accordingly, the writ petition stands disposed of leaving it open for the writ petitioner to approach the Tribunal having territorial jurisdiction over the matter. (Vikas Budhwar,J.)
