This petition under Article 226 of the Constitution of India lays a challenge to the order dated 22.05.2023 passed by the Armed Forces Tribunal, Principal Bench, New Delhi (hereinafter, ‘Tribunal’) in O.A. 1085/2020, whereby the Tribunal has allowed the O.A. filed by the respondent herein by stating in paragraphs 7 and 8 as under: “7. In view of the aforesaid judicial pronouncements and the parameters referred to above, the applicant is entitled for disability element of pension in respect of disability ‘Primary 2014. 8. The respondents are thus directed to ca
