Heard Sri Mohammad Imran, the learned counsel for the petitioner, Sri Dhiraj Ojha, the learned Standing Counsel appearing on behalf of the State and perused the record. 2. By means of the instant petition filed in public interest the petitioner has sought a direction to the opposite parties no.2 and 3 for removal of encroachment of on the public utility land bearing Gata No.61-SA, measuring 0.0200 hectare situated in Village Singariya Pure Vali Deen Ka Purwa, h/o Paraspur, Tehsil Karnailganj, District Gonda. 3. On the basis of instructions provided by the Tehsildar, Kunda, District Pratapgarh the learned Standing Counsel states that a spot inspection was carried out and it was found that there is no encroachment on the land in question.
