The matter was repeatedly placed before the learned Joint Registrar for taking of action to implead the legal representatives of the appellant. 2. The last order dated 6 January 2026 of the learned Joint Registrar records the fact that no application for impleading the legal representatives of the appellant was filed despite opportunities having been given on 4 August 2025, 12 September 2025 and 11 December 2025. 3. There is no appearance on behalf of the appellant today either. No application to implead the legal representatives of the deceased appellant is on record even as on date. It appears that the legal representatives of the appellant are not interested in prosecuting the matter. 4. The appeal accordingly abates. It is dismissed on the said ground as well as for non-prosecution. 5. Needless to say, this would not preclude the legal representatives of the appellant from moving an appropriate application for revival of the proceedings in accordance with law, in case they are so advised.
