CORAM: HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T (oral) 1. Petitioner herein seeks quashing of FIR No. 741/2016, dated 17.10.2016, registered at P.S. Khajuri Khas under Sections 279 and 338 of Indian Penal Code (IPC). 2. The petitioner was driving an Ambulance when he, allegedly, hit one scooty from behind. 3. The injured i.e. scooty driver- Mr. Soudan Singh Tomar received grievous injuries. 4. The above accident had taken place in the year 2016. 5. According to petitioner, the mechanical inspection report belies the manner in which the prosecution has projected the entire story. 6. He submits that as per the case set up by the prosecution, the ambulance had hit the scooty from behind but Mechanical Inspection Report does not indicate any fresh damage on the front side of the offending vehicle i.e. ambulance. He also submits that there was no eye witness of the incident in question and the son of the injured has been falsely shown as eye witness. When asked, learned counsel for the State, on instructions, submitted that concerned injured is no longer alive and has already died for the reason, other than the accident in question. 8. After some arguments, learned counsel for petitioner, while reserving all his rights and contentions, does not press the present petition. 9.
