Yasir, Advocate holding brief of Sri Shams Uz Zaman, learned counsel for the applicant, Sri Sunil Kumar, learned A.G.A. for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.240 of 2001, under Sections 302, 201 I.P.C., Police Station Binauli, District Baghpat, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is not named in the FIR and has been falsely implicated in the present case. His name has come up subsequently after a delay of more than 22 years of the incident and he has been nominated using the word as 'alias'. Had the applicant committed the said offence, his name would have been mentioned in the FIR itself. Even after the delay of 22 years, the applicant has been nominated on the basis of suspicion only. 5. Learned counsel for the applicant has further argued that
