Heard Sri Ashwani Kumar Pathak, learned counsel for the applicant, Sri Jai Kishan Chaurasia, learned State Law Officer for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.232 of 2025, Session Trial No.2560 of 2025, under Section 103(1) B.N.S., Police Station Belipar, District Gorakhpur, during the pendency of trial. 4. As per prosecution story, the applicant is stated to have stabbed his uncle on 21.07.2025 at about 1:00 p.m. in an orchard. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by about 8 hours and there is no explanation of the said delay caused. The applicant has rushed the deceased to hospital as is evident from the statement of eye-witness Munnilal.
