Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. It is further argued that the applicant is not named in the FIR. Subsequently, he has been nominated on the basis of CDR and the conversation with the deceased, which has no evidentiary value in the eyes of law. Even the CDR does not indicate the presence of the applicant at the place of occurrence. Rather, he has been seen in the vicinity thereof. No proof of his presence has been fetched by the police. 5.
