Patel, learned State Law Officer and perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 361 of 2025, under Sections 103(1), 109(1), 3(5), 61(2)(a) B.N.S., Police Station Kairana, District Shamli, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. It is further argued that the applicant is not named in the FIR. Subsequently, he has been nominated on the basis of CDR and the conversation with the deceased, which has no evidentiary value in the eyes of law. Even the CDR does not indicate the presence of the applicant at the place of occurrence. Rather, he has been seen in the vicinity thereof. No proof of his presence has been fetched by the police. 5.
