Heard Sri Sumit Goyal, learned counsel for the applicant, Sri Sunil Kumar, learned A.G.A. for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.353 of 2025, under Sections 103(1), 123, 238(b) B.N.S., 2023, Police Station Nakur, District Saharanpur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the the FIR is delayed by about four and half months and there is no explanation of the said delay caused. The informant was present at the time of inquest proceedings and it has come up that the cause of death was drowning and later on, during the post-mortem examination, the cause of death could not be ascertained and viscera was preserved, and organo-phosphorus insecticide was found in it. 5.
