Applicant seeks bail in Case Crime No.190 of 1991, under Sections 147, 302/149 I.P.C., Police Station Sultanpur Ghosh, District Fatehpur, during the pendency of trial. 4. Learned counsel for the applicant has stated that the applicant is languishing in jail since 28.09.2016, as such, the period of incarceration comes out to be nine years and four months. The fundamental rights of the applicant enshrined under Article 21 of the Constitution of India stand violated. Only one witness has been examined to date and there is no likelihood of conclusion of trial in near future. There is no criminal history of the applicant.
