Court No. - 65 HON'BLE DR. GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record. 2. Learned counsel for the applicant submits that the F.I.R. was lodged in unknown regarding missing of informant's daughter aged about 19 years. The victim in her statements recorded under Sections 180 & 183 BNSS has stated that she is 19 years of age, on the alleged date the applicant enticed her away and took her to Sambhal where he committed her rape several times. The victim went missing on 29.11.2025, the F.I.R. was lodged on 30.11.2025 and the victim returned her home on 02.12.2025 and on the same day she was medically examined wherein no external or internal injury was seen on her person, no dead or alive spermatozoa was seen in her vaginal smears, thus, medical evidence does not support the allegation of rape though the victim was medically examined promptly.
