Court No. - 65 HON'BLE DR. GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the material brought on record. 2. Learned counsel for the applicant submits that applicant is named in the F.I.R. Initially the F.I.R. was lodged under Sections 64, 351(2) B.N.S. and Section 3/4 of Protection of Children From Sexual Offences Act, but after investigation the provisions of POCSO Act have been dropped. In the FIR it has been alleged by the informant that when on 11.08.2025 his mentally retarded daughter was sleeping in her house along with her two brothers, then in the midnight the applicant came there and committed her rape and he also threatened both the brothers of the victim who were laying beside her. It has also been stated in the FIR that blood is present in the clothes of the victim and in the bed also upon which the victim was sleeping. Statements of the victim under Sections 180 & 18
