GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record. 2. Learned counsel for the applicant submits that the F.I.R. was lodged by the victim making allegation of rape against the applicant. In her statements recorded under Sections 180 & 183 BNSS the victim had reiterated the version of rape. As per prosecution version the victim is a married woman aged about 22 years, The alleged incident took place on 11/12.05.2025, the F.I.R. was lodged on 14.05.2025 and the victim was medically examined promptly on the next day, i.e., 15.05.2025, but in her medical examination no fresh internal or external injury was found on her person and her hymen was old, torn and healed, thus, medical evidence does not corroborate with the allegation of forcible rape committed upon her.
