Heard Sri Sanjeev Kumar Singh, learned counsel for the applicant and Sri Omar Zamin, learned counsel for the informant as well as Sri Jai Kishan Chaurasia, learned State Law Officer and also perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 0463 of 2025, under Sections 103(1), 190, 191(2), 191(3) of BNS, Police Station - Gagaha, District - Gorakhpur, during the pendency of trial. 4. At the outset, learned counsel for the applicant has claimed parity with the co-accused but his case is not at par with the co-accused as the applicant is visible in the CCTV footage. 5. Learned counsel further submits that the FIR has been lodged with a delay of about two days, for which no plausible explanation has been furnished by the prosecution.
