The present Criminal Appeals has been filed under Section 374 (2) of the Code of Criminal Procedure, 1973 challenging the judgment and order dated 25.01.1984, passed by the learned Vth Additional Judge, Shahjahanpur, in Sessions Trial No. 91 of 1983, arising out of Case Crime No. 430 of 1982, under Sections 302,302/34,394 IPC, Police Station- Tilhar, District- Shahjahanpur. 2. By the impugned judgment,
