The above noted appeal was heard by appointing Sri Sangam Lal Kesharwani, as amicus curiae on behalf of the appellants to argue this appeal vide order dated 06.01.2026. Thereafter, the matter was listed on 20.01.2026 and passed over on the illness slip of earlier counsel Sri Rajesh Pathik and directed to be listed on 27.01.2026. 3. On 27.01.2026 the matter was heard finally, but by over sight the report of C.J.M., Shamli dated 17.01.2026 was not seen according to which the only surviving appellant no.1, Satypal Singh, son of Umrao, had also died on 16.12.2023. 4.
