Kotwal, J.) 1) The Appellant has challenged the Judgment and Order dated 27 th April 2023, passed by the learned Additional Sessions Judge, Pune in Sessions Case No.255 of 2010. Vide the impugned Judgment and Order, RvC 1/34 902. Apeal 629-2023.doc the Appellant was convicted for commission of offence punishable under Section 302 of the Indian Penal Code (in short “I.P.C.”). He was sentenced to suffer life imprisonment and to pay a fine of Rs.3,000/-, and in default to suffer further rigorous imprisonment for six months. He was acquitted from the charges of commission of offence punishable under Section 324 of the I.P.C. The Appellant was arrested on 11 th November 2009 and he was granted bail pending trial on 9 th December 2010. He was given set-off under Section 428 of the Code of the Criminal Procedure.
