By the aforesaid order, a direction was given to initiate the proceedings pursuant to the report dated 09.01.2026 in which it is stated that the petitioner has illegally constructed the Chabutara on the state land/ Rasta. 3. It is argued that before passing the aforesaid order, no notice or opportunity has been provided to the petitioner. 4. This fact is also clear from perusal of the aforesaid report. 5. In this view of the matter and also in the interest of justice, the petitioner is permitted to move a reply to the aforesaid letter before the Respondent No.3 namely Sub Divisional Magistrate, Tehsil Jewar, District Gautam Budh Nagar.
