It is argued by learned counsel for the petitioner that by order dated 04.04.2013 passed by the Additional Commissioner (Administration) Gorakhpur Division Gorakhpur in Revision No.259/283/M2008 (Surendra Singh Vs. Shyam Bihari), the matter was remanded before the respondent No.3/Sub Divisional Magistrate Tehsil Sadar District Maharajganj. It is argued that more than ten years have been lapsed but till date no decision has been taken by the respondent No.3 in the matter. 2. In this view of the matter present petition is disposed of directing the respondent No.3/Sub Divisional Magistrate Tehsil Sadar District Maharajganj. to decide the case No.9/83/04 strictly in accordance with law but after providing opportunity of hearing to the parties concerned unless there is no legal impediment.
