The order dated 03.01.2026 passed by the respondent no.2 in the proceedings initiated against the petitioner by the respondent no.5 under Section 38(1) of the U.P. Revenue Code, 2006 is under challenge. 2. A preliminary objection has been raised by learned Standing Counsel that against the order impugned statutory alternative remedy is available to the petitioner to file an appeal before the Commissioner as provided under sub-Section (4) of Section 38 of the U.P. Revenue Code, 2006. 3. At this stage, a prayer has been made to dismiss present writ petition on the ground of availability of statutory alternative remedy available to the petitioner. 4.
