In this view of the matter, the Court is of the opinion that filing of the present writ petition during the pendency of the recall application is not maintainable and the same is liable to be dismissed and is hereby dismissed with liberty to the petitioner to file a fresh petition, if so advised after the decision has been taken by this Court in the aforesaid recall application (Prakash Padia,J.)
