In the proceeding initiated by the petitioner under Section 41 of U.P. Land Revenue Act, 1901, an order dated 20.08.2005 was passed by the respondent No.3/Tehsildar Tehsil Ghorawal, District Sonbhadra in favour of the petitioner. 2. It is argued by learned counsel for the petitioner that after the aforesaid order was complied with, the pillars were erected by the private respondents, hence a representation has been filed by the petitioner before the respondent No.3 but till date no action has been taken. 3. Heard learned counsel for the parties and perused the record. 4. In the facts and circumstances of the case and without entering into merits of the case, the present petition is disposed of permitting the petitioner to initiate proceedings as per procedure prescribed under U.P Revnue Code, 2006 as well as U.P.
