The petitioner has preferred the present petition with the prayer to direct the respondent No.2/Sub Divisional Magistrate, Tehsil Sadar, District Deoria to decide the Application dated 30.06.2003 under Order IX Rule 13 of Code of Civil Procedure, being Case No.350/150/91. 4. It is argued by learned counsel for the petitioner that considerable time has already been lapsed but till date no decision has been taken in the matter. 5. Heard learned counsel for the parties and perused the record. 6. In the facts and circumstances of the case and without entering into merits of the case, the present petition is disposed of
