The petitioners have preferred the present writ petition inter-alia with the prayer to quash the ex-party order dated 09.06.2025 passed by the Sub Divisional Magistrate (Judicial), Tilhar, District Shahjahanpur. 2. It is argued by the counsel for the petitioners that aforesaid order was passed against the petitioners in an ex-party manner and without providing any opportunity of hearing to the petitioner. 3. A preliminary objection has been raised by the learned Standing Counsel that the writ petition is liable to be dismissed on two grounds namely (i) remedy is available to the petitioners to file a recall application before the same authority or (ii) to file an appeal before the First Appellate Authority as provided under Section 207 of the Code of 2026. 4.
