In the proceedings initiated against the petitioner under Section 67 of the U.P. Revenue Code, 2006, an ex-party order was passed on 29.05.2018 by the Respondent No.3. Aggrieved against the aforesaid, time barred statutory appeal along-with an application of Section 5 of the Limitation Act was filed by the petitioner which was dismissed on the ground of laches vide order dated 13.10.2025. 2. Aggrieved against the aforesaid, the petitioner has preferred the present writ petition. 3. After some arguments, a prayer has been made by the counsel for the petitioner to permit the petitioner to move a recall application before the Respondent No.3 namely Assistant Collector First Division/ Tehsildar Judicial, Naugargh, Siddharth Nagar against the ex-party order dated 29.05.2018. 4.
