After some arguements counsel for the petitioner confined his prayer only in respect of prayer no.2, which reads as follows :- "(ii) issue writ, order or direction in the nature of Mandamus directing the Respondent No. 2 Naib Tehsildar, Sadar, Gorakhpur, District Gorakhpur to decide the preliminary objections dated 22.12.2025 and 17.12.2025 filed by the petitioner in Computerized Case No. T2017053135031785 (titled as 'Braham Gyan Singh Majithia (Deceased) Vs. Saraiya Sugar Mills) under Section 34 of U.P. Revenue Code, 2006 (Annexure-4 to the writ petition);" 2. The writ petition was duly entertained and learned Standing Counsel appearing on behalf of State was granted time to seek instructions vide order dated January 28, 2026. 3.
