After hearing the learned counsel for the parties, what comes out is that the impugned order dated 06.12.2024 has been passed against the petitioner imposing environment compensation to the tune of Rs. 14,30,000/- for the reasons mentioned therein, however, the reply dated 23.09.2024 of the petitioner to the show cause notice dated 09.08.2024 and the documents etc. annexed with it have not been considered at all while passing the impugned order. Post issuance of show cause notice certain reports were requisitioned from the the Regional Office, which were received on 09.11.2024, which have been referred in the impugned order but a copy of the same was also not provided to the petitioner. No hearing was given as is claimed.
