The petitioner wants removal of a Gular Tree existing in front of his house no.350 Kha, Vivekanand Colony, Takrohi, Lucknow. 4. Nagar Nigam counsel says that the Nagar Nigam does not have authority to cut the tree as it exists on a private land, whereas the petitioner's counsel says that it is partly on road land and partly on private land. 5. Counsel for the Nagar Nagam relies upon The Uttar Pradesh Protection of Trees Act, 1976 under which the Divisional Forest Officer is competent to consider such plea, subject to satisfaction of pre-requisites. 6.
