The petitioner seeks a mandamus to opposite parties Nos. 2 to 4 i.e. the official opposite parties to stop the illegal construction of drain (naali) by the opposite party No.5 i.e. the Chairman, Nagar Panchayat Fatehpur, District-Barabanki. The Nagar Panchayat has not been impleaded as an opposite party only the Chairman has been impleaded. This apart this is not an issue which can be sorted out by the opposite party Nos.2 to 4. The petitioner can seek such relief as may be permissible in law against the Nagar Panchayat or the Chairman, if there is a cause, but not by way of a writ petition as the land on which the drain (naali) is being constructed is abadi land and issues of possession, title etc., may be involved. 3.
