It is informed that some report has been sent to the State Government for considering taking action against the opposite party no. 5 under Section 48 etc. of the U.P. Municipalities Act, 1916 and the matter is pending at the level of the State Government. It is also informed that before taking decision the State Government will have to give an opportunity of hearing to the opposite party no. 5 as is envisaged under Section 48 of the U.P. Municipalities Act, 1916 itself. 3. In view of the aforesaid, we see no reason to issue notice to the opposite party no. 5 and accordingly pass this order without prejudi
